Pre-Trip Checklist & Waiver

Waiver of Liability between Participant and Native Girl Kayaking, LLC.

Please read through the items below before your tour. You'll be asked to review and sign the physical copy of this waiver on the day of your kayaking excursion. By booking a tour, you confirm that you understand and agree to each of the following.

  • I am at least 18 years of age.
  • I am not currently under the influence of drugs or alcohol.
  • I am able to listen and understand the directions given to me by the guide.
  • I will keep my lifejacket on for the entire duration of the tour.
  • I will wear a helmet at all times.
  • I will not go beyond the designated perimeter area shown to me by the guide.
  • I will not engage in horseplay or other potentially endangering activity.
  • I will not put my hands or feet into the water at any time.
  • If I am assigned as secondary emergency helper, I understand my role in the event of an emergency.
  • I understand the safety and emergency protocol and what to do if it goes into effect.
  • I do not have any current or pre-existing medical conditions which would be exacerbated by these activities (heat, sun exposure, physical exertion, anxiety, etc.) and represent that I am able to safely engage in these activities.
  • I understand that Native Girl Kayaking will not cover any medical bills or expenses incurred, related to this activity, from start to finish.
  • I understand that I am agreeing to engage into an inherently dangerous activity and there is a possibility of loss or damage of property, minor injury, serious injury, or even death and hereby assume the risk of all injury, including transportation, loading and unloading, and all water activities. I understand there is a possibility that another kayaker could cause me danger, injury, or death, whether unintentional or intentional.
  • I am of able mind and body to understand the above stated, and able to perform these activities without causing harm or danger to myself or other participants.
  • I understand the safety protocol that was explained to me by the guide, and agree to abide by it, and all other rules and directions told to me by the guide at any point in time during the activity.
  • The guide may at any time, for safety reasons, end the trip at the guide's sole discretion. In the event, Native Girl Kayaking shall in good faith review the decision and, only if it is an abuse of discretion, refund some or part of any compensation.
  • I understand that Native Girl Kayaking is not responsible for any personal possessions I might lose on the tour, or any damages or theft that occurs at any point in time during the trip. Native Girl Kayaking is not responsible for damages to my person, property, or vehicle.
  • I understand that I am responsible for paying to replace any item given to me by Native Girl Kayaking, used in the activity (such as paddle, fan, helmet, lifevest).
  • I understand that all pictures and videos taken of me at any time during the tour are property of Native Girl Kayaking, and can be used for marketing and advertising purposes on any platform seen fit. I hereby grant and convey unto Native Girl Kayaking, its heirs and successors, the use of my name, image, and likeness to use all pictures and videos in this section for commercial purpose.
  • I understand that I cannot bring my own personal bottle or container of liquid, and will be given water for the tour.
  • I understand that there is a possibility of becoming sunburnt, and I will prepare myself for sun exposure prior to arriving.
  • I understand that if I use any equipment or property of Native Girl Kayaking, Native Girl Kayaking makes no warranty, and I hereby waive and release Native Girl Kayaking of any warranty, including, but not limited to, fitness of use.
  • I understand that I may not be refunded if I do anything to endanger myself or other participants, and the trip may be ended immediately for everyone in the group.
  • I understand that when I booked this trip, I assumed the risk of cancellation, and, accordingly, I may not get a refund if I am a "no-show," have a scheduling conflict, change my mind, or for any other reason. Native Girl Kayaking may, in its discretion, offer a time to reschedule or a refund that is wholly gratuitous and in its sole discretion.
  • I understand and agree to the Terms and Conditions of Kayaking Agreement with Native Girl Kayaking, LLC. found on nativegirlnatchez.com and possessed by the guide.

On the day of your tour, you will sign the physical waiver with your guide before launch.
